Why speak up?

Reporting suspected misconduct helps us identify and fix issues early, protect people and the environment, and uphold our legal and ethical obligations under the Corporations Act 2001 whistleblower protections.

You’re protected when you make an eligible disclosure—this can include immunity from certain legal liability, protection of your identity, and protection from victimisation.

Who can make a report?

Anyone connected to Freshcare—current or former staff, contractors, certification bodies (and their personnel), participating businesses and their staff, volunteers, interns, students, and other associates—can make a protected disclosure.

What you can report (Disclosable Matters)

Report if you have reasonable grounds to suspect misconduct or an improper state of affairs, including:

  • Dishonest, fraudulent or corrupt behaviour
  • Illegal conduct (e.g., theft, violence, illicit drugs)
  • Serious breaches of Freshcare policies or oppressive/negligent practices
  • Conduct likely to harm Freshcare, others, public safety, health, or the financial system
  • Harassment, bullying, discrimination or victimisation related to misconduct reports

Not usually covered: personal work-related grievances (e.g., interpersonal conflicts, performance or promotion decisions). These should go through our HR/Grievance process.

How You’re Protected

  • Confidentiality: We won’t disclose your identity (or information likely to identify you) unless you consent or we’re legally required (e.g., ASIC/ATO/AFP). We use measures like redaction, restricted access and secure records.
  • Protection from detriment: It’s illegal to victimise someone for making a disclosure. If you experience detriment (e.g., dismissal, demotion, harassment, reputational harm), you may be entitled to remedies. Report concerns immediately (see “How to lodge”).
  • Anonymous reports welcome: You can use a pseudonym and still receive legal protection. We’ll investigate based on the information available.

How to Lodge a Report to Freshcare

Choose the option that feels safest and most convenient for you. You can report identified or anonymously.

External Reporting

If internal channels are not appropriate, disclosures can be made to Regulators (ASIC, ATO, or the Fair Work Ombudsman) or a legal practitioner (to obtain legal advice about whistleblower protections)

What to include (if you can)

  • What happened, when/where, who was involved
  • Any evidence or documents (or where they can be found)
  • Whether you fear immediate risk or detriment
  • How we can contact you (if you’re comfortable sharing)

You can still report if you don’t have all the details.

What happens next

  • Assess: A WPO assesses if your disclosure is eligible and the best investigation pathway (internal or external investigator).
  • Investigate: We collect facts fairly and securely.
  • Update: Where practicable, we provide progress updates and outcomes (subject to legal limits and privacy).
  • Action: We take appropriate action and store a final report securely.

Our Commitment

Freshcare encourages disclosures made in good faith and will take all reasonable steps to safeguard whistleblowers and address issues promptly. This policy is reviewed at least every three years or sooner if laws or organisational needs change.
